The APA requires a reviewing court docket to put aside company motion that’s “arbitrary, capricious, an abuse of discretion, or in any other case not in accordance with legislation,” “opposite to constitutional proper,” “in extra of statutory jurisdiction,” or “unsupported by substantial proof.” The proposal, if finalized, would fail every requirement.
